This Privacy Policy describes how PN Investment Holdco LLC (“Panther,” “we,” “us,” or “our”) collects, uses, discloses, and protects information about visitors to the website located at www.panthernational.com (the “Site”) and prospective and current members, residents, and guests of Panther National (the “Community”).
This Policy applies to information we collect through the Site and through related interactions — for example, when you submit an inquiry, join an interest list, attend an event, or correspond with us by email. It does not apply to information collected by third parties whose practices are governed by their own policies.
By using the Site or providing information to us, you acknowledge that you have read and understand this Policy.
1. Information We Collect
a. Information You Provide
We collect information you submit through forms or correspondence, which may include:
- identifiers such as name, email address, telephone number, and postal address (city, state, country);
- demographic and lifestyle information you choose to share (for example, residence location, family situation, recreational interests);
- the content of inquiries, comments, or requests you submit;
- real estate or membership preferences (for example, home type, price range, timeline).
b. Information Collected Automatically
When you visit the Site, we and our service providers automatically collect certain technical information, which may include:
- IP address and approximate location derived from it;
- device identifiers, operating system, browser type and version;
- pages viewed, links clicked, time spent on the Site, referring and exit pages;
- date and time of access.

c. Information from Third Parties
We may receive information about you from:
- our affiliated entities (for example, other Ohana-affiliated brands);
- service providers and marketing partners;
- publicly available sources;
- referral sources (for example, brokers or members who introduce you to the Community).
2. How We Use Information
We use the information we collect to:
- respond to your inquiries and provide requested information about the Community, real estate, and membership;
- send marketing communications about the Community, events, programming, and offerings (you can opt out at any time);
- operate, maintain, secure, and improve the Site;
- analyze Site usage and measure the performance of our marketing;
- personalize content and communications;
- maintain records and comply with legal obligations;
- detect, prevent, and respond to fraud, abuse, security incidents, and unlawful activity;
- enforce our Terms and Conditions and other agreements;
- carry out any other purpose described to you at the time of collection or with your consent.
3. How We Share Information
We may disclose your information in the following circumstances:
a. Service Providers
We share information with third-party vendors who perform services on our behalf, such as website hosting, email delivery, analytics, CRM, marketing automation, customer service, and IT support. These providers are contractually obligated to use the information only as needed to perform services for us.
b. Affiliates
We may share information with our affiliated entities, including Ohana Real Estate Investors and its affiliated properties and brands, for the purposes described in this Policy.
c. Brokers and Sales Professionals
If you indicate interest in real estate at the Community, we may share your information with licensed brokers, sales professionals, or referral partners involved in the offering.
d. Business Transfers
If Panther is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, your information may be transferred as part of the transaction.
e. Legal and Safety
We may disclose information when we believe disclosure is necessary or appropriate to (i) comply with applicable law, regulation, legal process, or governmental request; (ii) enforce our agreements; (iii) protect the rights, property, or safety of Panther, our personnel, our guests, or others; or (iv) prevent or investigate suspected fraud or wrongdoing.
f. With Your Consent
We may share information for other purposes with your consent. We do not sell your personal information for money. See Section 7 below for details on California “sales” and “sharing” definitions and how to exercise your rights.
4. Cookies and Tracking
We and our service providers use cookies, pixels, web beacons, and similar technologies to operate and analyze the Site. For details about the categories of cookies we use and your choices, see our Cookie Policy.
We do not currently respond to “Do Not Track” browser signals because no industry standard for these signals has been established. We do honor opt-out preference signals as required by applicable law (see Section 7).
5. Email Communications
With your consent (for example, by submitting your email through an interest list form), we may send you marketing emails about the Community and related offerings. You may opt out at any time by clicking “unsubscribe” in any marketing email or by emailing us at [panther@ohanare.com]. Even if you opt out of marketing, we may still send you transactional or relationship messages (for example, responses to inquiries you have submitted).
6. Data Security and Retention
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, or disclosure. No method of transmission over the Internet or electronic storage is completely secure, however, and we cannot guarantee absolute security.
We retain personal information for as long as is needed to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need information, we will dispose of it in accordance with our retention practices.
7. State Privacy Rights
This Section provides additional disclosures and rights for residents of states with comprehensive consumer privacy laws, including California, Colorado, Connecticut, and Virginia.
a. Categories of Personal Information Collected
In the prior twelve (12) months, we have collected the following categories of personal information (as defined by the California Consumer Privacy Act, as amended by the California Privacy Rights Act, collectively the “CCPA”):
- Identifiers (name, email, phone, postal city/state, IP address, device identifiers);
- Customer records information (information you submit on forms);
- Commercial information (interest in real estate or membership, preferences);
- Internet or network activity information (browsing activity on the Site);
- Geolocation data (approximate, derived from IP address);
- Inferences drawn from the above (for example, likely interest in particular offerings).
We do not knowingly collect sensitive personal information beyond what users voluntarily provide.
b. Sources, Purposes, and Recipients
We collect personal information from the sources described in Section 1, use it for the purposes described in Section 2, and disclose it to the categories of recipients described in Section 3.
c. Sale and Sharing
- We do not “sell” personal information in exchange for money.
- We do not currently “share” personal information for cross-context behavioral advertising as defined under the CCPA.
- We do not knowingly sell or share personal information of consumers under sixteen (16) years of age.
d. Your Rights
Subject to verification of your identity and applicable legal exceptions, you may have the following rights:
- Right to Know / Right to Access — request the categories and specific pieces of personal information we have collected about you;
- Right to Delete — request deletion of personal information we have collected from you;
- Right to Correct — request correction of inaccurate personal information;
- Right to Portability — request a copy of your personal information in a portable format;
- Right to Opt Out of Sale or Sharing — opt out of any “sale” or “sharing” of personal information;
- Right to Limit Use of Sensitive Personal Information — where applicable;
- Right to Opt Out of Profiling or Targeted Advertising — where applicable;
- Right to Non-Discrimination — we will not discriminate against you for exercising your privacy rights.
e. How to Exercise Your Rights
You may submit a request by:

We will verify your identity using information we already have or by requesting additional information. You may designate an authorized agent to make a request on your behalf; we may require proof of authorization.
f. Right to Appeal (Colorado, Connecticut, Virginia)
If we deny your request, you may appeal by contacting us at [panther@ohanare.com] with “Privacy Appeal” in the subject line. We will respond within the timeframe required by applicable law.
g. California “Shine the Light”
California residents may request a list of third parties to whom we have disclosed personal information for those parties’ direct marketing purposes during the prior calendar year. We do not currently share personal information for third-party direct marketing in a manner that triggers this disclosure.
8. Children’s Privacy
The Site is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen. If we learn that we have collected personal information from a child under thirteen, we will delete it. 9. Changes to This Policy
We may update this Policy from time to time. If we make material changes, we will notify you by posting a revised version on the Site and updating the “Last Updated” date above. We encourage you to review this Policy periodically.
